Terms & Conditions

Last updated: 2026

These Terms & Conditions (“Terms”) govern your use of the Wenickay website, platform and related services (collectively, the “Platform”).

By accessing or using Wenickay, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Platform.

In these Terms, “Wenickay”, “we”, “us” or “our” refers to the operator of the Wenickay Platform. “You” or “your” refers to any person or organisation accessing or using the Platform.

1. About Wenickay

Wenickay provides an online platform designed to make it simple for users to create, organise, publish and manage online courses.

The Platform may provide tools for creating course content, managing learners, delivering learning materials, administering assessments and managing other aspects of online learning.

Wenickay is a technology platform. Unless expressly stated otherwise, we are not responsible for the educational content created or uploaded by users.

2. Eligibility

You must be at least 18 years old to create an account or use Wenickay as a course creator.

If you are using Wenickay on behalf of a business, organisation or other legal entity, you confirm that you have authority to accept these Terms on its behalf.

By using the Platform, you confirm that the information you provide to us is accurate and up to date.

3. Your Account

Some features of Wenickay may require you to create an account.

You are responsible for:

  • providing accurate registration information;
  • keeping your account information up to date;
  • maintaining the confidentiality of your login details;
  • keeping your password secure;
  • all activity carried out through your account; and
  • notifying us promptly if you believe your account has been accessed without your permission.

You must not share your account credentials with another person unless your chosen Wenickay plan expressly permits this.

We reserve the right to suspend or restrict an account where we reasonably believe that the account has been used in breach of these Terms or poses a security risk to the Platform or other users.

4. Creating Courses

Wenickay allows users to create and manage online courses.

As a course creator, you are responsible for:

  • the accuracy and quality of your course content;
  • ensuring that your content is suitable for your intended audience;
  • obtaining all necessary rights and permissions for content you upload;
  • ensuring that your courses comply with applicable laws and regulations; and
  • responding appropriately to learners who access your courses.

Wenickay does not guarantee that a course will achieve any particular educational, professional, financial or other outcome.

You are responsible for ensuring that any claims, qualifications, certificates or outcomes associated with your course are accurate and not misleading.

5. Your Content

You retain ownership of the original content that you upload to Wenickay, including course materials, text, images, videos, documents and other materials (“Your Content”).

By uploading Your Content to Wenickay, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display and transmit Your Content as reasonably necessary to provide, maintain, improve and secure the Platform.

This licence continues for as long as Your Content is hosted on the Platform and for a reasonable period afterwards where necessary for backups, legal compliance or technical purposes.

You are responsible for ensuring that you have the necessary rights to upload and use Your Content.

You must not upload content that infringes another person’s copyright, trademark, privacy, confidentiality or other rights.

6. Intellectual Property

All intellectual property rights in the Wenickay Platform, including its software, design, branding, logos, features, graphics and underlying technology, belong to Wenickay or our licensors.

Except where expressly permitted by these Terms, you must not:

  • copy or reproduce the Platform;
  • modify or create derivative works of the Platform;
  • reverse engineer or attempt to discover the source code;
  • sell, licence or commercially exploit the Platform or any part of it;
  • remove copyright, trademark or other proprietary notices; or
  • use Wenickay’s branding without our prior written permission.

Your use of Wenickay does not transfer ownership of the Platform or its intellectual property to you.

7. Acceptable Use

You must use Wenickay lawfully and responsibly.

You must not use the Platform to:

  • upload or distribute unlawful, fraudulent or misleading material;
  • infringe intellectual property or other legal rights;
  • distribute malicious software, viruses or harmful code;
  • harass, threaten or abuse other users;
  • impersonate another person or organisation;
  • attempt to gain unauthorised access to accounts, systems or data;
  • interfere with the security or operation of the Platform;
  • use the Platform to conduct unlawful activities; or
  • use automated methods to access or extract data from the Platform without our permission.

We may investigate suspected breaches and take appropriate action, including removing content, restricting access or terminating accounts.

8. Course Learners

Where Wenickay is used to deliver courses to learners, learners are responsible for using course content for legitimate educational purposes.

Course content may be subject to restrictions imposed by the course creator or applicable licence terms.

Unless expressly permitted, learners must not:

  • copy or redistribute course materials;
  • share paid course access with others;
  • record or reproduce course content for commercial purposes;
  • sell or sublicense course materials; or
  • provide access to course content to people who are not authorised learners.

9. Payments and Fees

Certain Wenickay features or services may require payment.

Where applicable, prices, billing periods and payment terms will be displayed before you complete a purchase or subscription.

You agree to provide accurate payment information and authorise us, or our payment provider, to charge the applicable fees.

We may change our prices from time to time. Where changes affect an existing subscription, we will provide appropriate notice before the new price takes effect.

Any applicable taxes will be handled in accordance with applicable law.

10. Subscriptions and Cancellation

Where you have a recurring subscription, you may cancel it in accordance with the cancellation process provided through the Platform.

Cancellation will normally prevent future renewal but does not automatically entitle you to a refund for amounts already paid, except where required by law or where our refund policy states otherwise.

Nothing in these Terms limits your statutory rights as a consumer.

11. Refunds and Consumer Rights

If you are a consumer, you may have rights under UK consumer protection legislation, including rights relating to digital content and digital services.

Nothing in these Terms is intended to exclude or restrict any rights that cannot legally be excluded or restricted.

Where applicable, details of any specific refund or cancellation policy will be provided at the point of purchase.

12. Third-Party Services

Wenickay may integrate with or rely on third-party services, including payment providers, hosting providers, analytics services, email services and other technology providers.

Your use of third-party services may be subject to their own terms and privacy policies.

We are not responsible for the operation, availability or policies of third-party services that we do not control.

13. Platform Availability

We aim to keep Wenickay available and reliable, but we do not guarantee that the Platform will always be available, uninterrupted or error-free.

The Platform may occasionally be unavailable due to:

  • maintenance;
  • updates;
  • technical problems;
  • security incidents;
  • third-party service failures;
  • internet or telecommunications problems; or
  • circumstances beyond our reasonable control.

We may modify, suspend or discontinue features of the Platform where reasonably necessary.

14. User Content and Moderation

We do not routinely review every piece of content uploaded by users.

However, we reserve the right to review, remove, restrict or disable access to content where we reasonably believe that it:

  • breaches these Terms;
  • violates applicable law;
  • infringes another person’s rights;
  • creates a security or safety risk; or
  • may harm Wenickay, its users or third parties.

We may cooperate with lawful requests from relevant authorities where required.

15. Accuracy of Information

Wenickay provides tools and services to support course creation and delivery.

We do not guarantee that information provided through the Platform will always be complete, accurate or current.

Course creators are responsible for checking the accuracy of their own course content.

Wenickay does not endorse or independently verify the educational, professional or other claims made by individual course creators unless expressly stated.

16. No Guarantee of Results

Wenickay provides technology and tools for creating and delivering courses.

We do not guarantee that using Wenickay will result in:

  • increased revenue;
  • increased course sales;
  • employment;
  • qualifications;
  • professional advancement;
  • learner completion;
  • educational outcomes; or
  • any other particular result.

Results will depend on factors including your content, audience, marketing, subject matter and how you use the Platform.

17. Privacy

Your use of Wenickay is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information.

Privacy Policy: https://learn.wenickay.co.uk/privacy-policy/

18. Security

We take reasonable measures to protect the Platform and information processed through it.

However, no online service can guarantee absolute security.

You acknowledge that internet-based services carry inherent security risks and agree to take reasonable steps to protect your own account and information.

19. Limitation of Liability

To the maximum extent permitted by law, Wenickay shall not be liable for indirect, incidental, special or consequential loss arising from your use of the Platform.

This may include loss of profits, revenue, business opportunities, reputation, data or anticipated savings.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, our total liability to you arising from your use of the Platform shall be limited to the amount you have paid to Wenickay for the relevant service during the twelve months preceding the event giving rise to the claim.

This limitation does not apply where prohibited by applicable law.

20. Indemnity

To the extent permitted by law, you agree to indemnify Wenickay against reasonable losses, claims, liabilities and expenses arising from your breach of these Terms or your unlawful use of the Platform.

This includes claims arising from content that you upload or distribute where that content infringes another person’s rights or violates applicable law.

21. Suspension and Termination

You may stop using Wenickay at any time.

We may suspend or terminate your access to the Platform where we reasonably believe that:

  • you have breached these Terms;
  • you have engaged in unlawful activity;
  • your use presents a security risk;
  • your account is being used fraudulently; or
  • continued access could cause harm to Wenickay or other users.

Where reasonably practicable, we will provide notice before terminating access, except where immediate action is necessary for security, legal or other serious reasons.

Following termination, provisions that are intended to continue by their nature will remain in effect.

22. Deletion of Your Content

If your account is terminated or you choose to stop using Wenickay, we may delete Your Content in accordance with our data retention practices.

You are responsible for maintaining your own copies of important course materials.

Where reasonably possible, we may provide a period in which you can export or retrieve your content before permanent deletion. This may not be possible where content must be removed immediately for legal, security or other reasons.

23. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will take reasonable steps to notify users where appropriate.

The updated Terms will be published on the Platform with a revised “Last updated” date.

Your continued use of Wenickay after the updated Terms take effect constitutes acceptance of the revised Terms.

24. Changes to the Platform

We may add, remove, modify or improve features of Wenickay from time to time.

We may also discontinue features where reasonably necessary.

Where a change materially affects a paid service, we will take reasonable steps to provide appropriate notice.

25. Governing Law

These Terms and your use of Wenickay are governed by the laws of England and Wales, unless applicable law requires otherwise.

Subject to any mandatory consumer rights, the courts of England and Wales shall have jurisdiction over disputes arising from these Terms.

If you are a consumer living in another part of the United Kingdom, you may also have rights to bring proceedings in the courts of the part of the UK in which you live.
